Former Sailor Jose Rodriguez was brutally drugged kidnapped and raped missing for 3 days and left for dead after attending Richs Gay Night Club in San Diego, CA. Now he joins The Sanctuary Project Veterans in his fight for the repeal of Don’t Ask, Don’t Tell and is currently working on his miss handling of treatment, mental and physical care and discharge by the US Navy .

Jose Rodriguez reported that he was one of Captain Schnell’s favorites. Had many run in with the his former Captain. Captain recognized him many times. But when brutal drug rape kidnapping and being gay was reported to USS PELELIU. Captain Schnell was the last to know of the tragedy. The naval ship was notified of sailor being found alive. Ships deck department leads sent in department duty officer in charge to look into SN Rodriguez incident and hospitalization. Deck department ship is later notified by sailor sent to hospital, that SN Rodriguez is alive, will recover and has been brutally beaten, drugged and raped by a group of men. Sailor also reported that SN Rodriguez attended a gay night club and reported that SN Jose Rodriguez was gay.
SN Jose Rodriguez was ordered to return to USS PELELIU LHA5 right after being release from hospital. He was order to take an immediate drug screen since he appeared to have been drugged and came out positive for illegal substance that he did not willingly take. The ship was not concerned for SN Jose Rodriguez beating or rape. They were more concerned about getting a copy of the findings in the his system and later using it along with his discharge.
Captain Schnell and medical staff requested meeting with former Sailor SN Jose Rodriguez shortly after returning to the USS PELELIU from the hospital. SN Jose Rodriguez had questions on how the ship knew of his brutal drug rape kidnapping by detail. How was information leaked to 3000 sailors aboard USS PELELIU before his return to the ship. Ship had no answers to his questions.
Captain Schnell said, “I don’t care about your sexually preferences. Gay or straight. A mistake has been made. We didn’t know how to handle a Sailor being raped. What should have happened is that the medical officer should have been the one sent into hospital to retrieve you and your medical records with a HIPAA letter. The information of the findings should have been kept between me and the Medical Officer. We were only trying to help. We didn’t think we were doing harm in announcing what happened to you. We don’t think that the sailor who got your information did anything wrong. He was only trying to help. USS PELELIU LHA 5 is not properly trained on how to handle a male rape. We didn’t know what to do.”

Former Sailor Jose Rodriguez had his own questions now. Why would Captain Schnell bring up SN Jose Rodriguez being GAY? Who told he was gay? SN Jose Rodriguez feared for his life now. Scared of how Sailors aboard USS PELELIU would react after threatened by Captain Schnell to not speak of incident or bring it up or the would be sent to a Captains Mass for punishment. The Sailor who was sent to hospital confesses and says hospital staff member release medical information with out HIPAA document provided by US NAVY. Sailors privacy rights has now been violated by the hospital that treated Jose Rodriguez. Now former Sailor Jose Rodriguez is re victimized by US NAVY.
Sailors did not need to know of his personal life and tragedy. He began getting harassed and threatened for his for his life. Jose Rodriguez would later be removed from ship because he filed a complaint. File of incident would be trashed in front of him and told by former Captain Schnell that fill would be kept private and he would trash all evidence of the mistake and happenings to former Sailor Jose Rodriguez brutal drug rape kidnapping. Case closed.

Former Sailor SN Jose Rodriguez was not happy with the out come and sought out help from the Sanctuary Project Veterans. Founder Evelyn Thomas and Linda Sanders immediately came to his cry for help. The organization seeked help from Congresswoman Susan Davis and Attorney Dan Gilleon. US NAVY does not hesitate to admit that a thorough investigation was done and a sailor has been punished for breaching SN Rodriguez rights to the press. US Navy reports that SN Jose Rodriguez can not sue US Navy because of federal laws but can sue hospital for violating HIPAA laws.

Former sailor SN Jose Rodriguez was told not to speak of incident and refused by standing up for gay rights and raped victims in the military. SN Jose Rodriguez said, “ How are you going to tell me not to speak about what happened to me? How are you going to help me if I don’t speak so I could get the help? Why are you treating me like a criminal? How are you going to tell me that I am safe after being outted on a ship of 3000 sailors? How are you going to tell me now that gays can not serve in the military after you rated me a top sailor. 3 days before my abduction? This is why you don’t know how to treat a male being raped in the service and this is why your statistics are low for men being raped and reporting rape because they are scared on how they would be treated. I am being treated like a criminal when I am a victim of something that will affect me for the rest of my life.”
All the US NAVY had to say was, “Stay away from the LGBT Community, they will only re victimize you and they will only use you for there convince on fights to benefit the LGBT community and DADT.
Former Sailor SN Jose Rodriguez would later be discharge for requesting help for PTSD, ANXIOTY and DEPRESSION DISORDER after being diagnosed by naval doctors. But SN Jose Rodriguez is being strong for himself, the lgbt community, and raped men and women in the military. He has joined the Sanctuary Project Veterans on there fight for the repeal of DADT and still wait’s the investigation of the US NAVY to be completed. First to be relieved on August 15, 2010, by the US NAVY is Captain David Schnell of the USS PELELIU LHA 5. Jose Rodriguez believes that with the faith in God everything will come on its own at the end and his hurt will soon be put to rest. All former Sailor Jose Rodriguez has to say about his former Captain is, “Captain Schnell is an incompetent leader. This is a glaring example US Navy failure to educate and train flag officers such Captain Schnell properly and legally to Command and a diverse Naval Command. With the US NAVY’S failure, this has resulted in life long trauma to worsen. I accuse you of inhuman treatment to me personally and all those who are afraid to speak out. \

Even though this has happened to me, I refuse to except this for myself and others. I remain strong with the faith in God and I am an advocate with, The Sanctuary Project Veterans and our goal is to end this inhuman treatment in the military’s LGB community.
